Welcome to MyKaya (the "Platform", "we", "our", "us"). By accessing or using our website or application (https://mykaya.app), you agree to be bound by these Terms & Conditions ("Terms"). Please read them carefully.
You must be at least 18 years of age and legally capable of entering into a binding agreement under applicable law to use MyKaya.
MyKaya is a digital platform designed to assist mental health professionals with note-taking, client management, and AI-powered session insights. The platform does not replace professional judgment or constitute medical advice.
MyKaya acts as a Data Processor, handling session audio, transcripts, and notes on behalf of, and on the instructions of, the practitioner who controls the account. By using the service, you authorise us to process this content using secure, enterprise-grade cloud hosting and contracted AI providers to provide, operate, secure, and improve our services. We never sell, rent, or trade your data or your clients' data, and we are not a data broker.
Users are responsible for maintaining the confidentiality of their login credentials and for all activity that occurs under their account.
All user data is handled in accordance with our Privacy Policy. To the fullest extent permitted by applicable law, MyKaya shall not be liable for any loss, damage, or unauthorized access to personal information resulting from circumstances beyond its reasonable control, including but not limited to hacking, cyberattacks, malware intrusion, network failures, or other security breaches. MyKaya’s responsibility shall be limited to taking reasonable security measures. Users acknowledge and accept the inherent risks associated with transmitting information online and agree that MyKaya shall not be responsible for any indirect, incidental, or consequential damages arising from such events and/or use of the platform.
AI-generated outputs are designed to support, not substitute, clinical expertise. MyKaya assumes no liability for outcomes arising from reliance on automated analyses or recommendations.
For paid plans or subscriptions, users agree to the pricing and billing terms specified at the time of purchase. All payments are non-refundable unless otherwise stated in our Refund & Cancellation Policy.
All software, content and design, are owned by MyKaya.
We reserve the right to suspend or terminate accounts that violate these Terms or applicable laws without prior notice.
MyKaya reserves the right to modify, update, or change these Terms & Conditions at any time at our sole discretion without prior notice. Any changes will be effective immediately upon posting on this page. Your continued use of the platform after any such changes constitutes your acceptance of the new Terms.
These Terms are governed by the laws of India, and any disputes shall be subject to the jurisdiction of courts in Mumbai.
To ensure optimal performance and prevent abuse, MyKaya enforces a Fair Use Policy (FUP) on computationally intensive features.
Audio Processing: Indian language transcription and translation is subject to a limit of 40 hours of audio processing per billing cycle. English and other global language dictation remains completely unrestricted and is not subject to this cap. Users will receive a warning upon reaching 30 hours of Indian language processing. Upon reaching the 40-hour limit, consistent high-volume usage may require transitioning to a custom enterprise tier at our sole discretion.
Peer Pass (Referrals): When a colleague you referred upgrades to an Atlas plan, you earn a ₹400 cash payout paid via UPI/bank transfer. Payouts are subject to the following conditions: (a) The referrer and the referred party both must have maintained a continuous Atlas subscription for at least 90 days before becoming eligible to receive payouts; (b) Referrals are only eligible if the referred party's first paid upgrade is directly to an Atlas plan, and any purchase of a Compass pass (even if followed by a subsequent upgrade to Atlas) does not qualify for a referral payout; (c) Claims must be submitted manually between 90 and 180 days from the date of the referred party's upgrade by emailing team@mykaya.app with your UPI ID and bank account details; MyKaya reserves the right to review referral activity and modify or pause payouts at its sole discretion, and reserves the right to withhold payouts in cases of suspected abuse, self-referral, or violation of these terms.
Account Sharing: Account sharing is strictly prohibited. Each account is intended for use by a single practitioner only.
Clinics or organisations requiring higher volume should contact us at team@mykaya.app to discuss a custom plan.
Practitioners using MyKaya are responsible for obtaining informed consent from their clients for recording and processing sessions through MyKaya, in a manner that meets the standard required by applicable law, and for ensuring compliance with all applicable local regulations and professional ethics guidelines. MyKaya is not responsible for any violation of the terms agreed between a practitioner and their clients.
